Medical malpractice is the same entity as medical negligence, and therefore the terms are interchangeable. Medical malpractice events encompass all varieties of medical errors, from missed or delayed diagnoses to surgical mistakes or complications from medications. Medical errors in hospitals and other medical facilities are the third leading cause of death in the U.S., claiming 250,000 lives each year. This astounding statistic includes both deaths in hospitals and deaths resulting from medical errors, like failures to diagnose heart conditions, cancer, infections, stroke, and other ailments – the delay in diagnosis of which can cause serious harm and even death. Health care providers have an obligation to their patients under the circumstances in which the provider and patient meet, known as the standard of care.
The standard of care requires the health care provider to act as any reasonable health care provider would under similar circumstances, and experts in various health care fields are used to establish what this standard of care is in any given case.
